The shortage of organs for transplantation by its nature prompts ethical dilemmas. For example, although there is an imperative to save human life and reduce suffering by maximising the supply of vital organs, there is an equally important obligation to ensure that the process by which we increase the supply respects the rights of all stakeholders. In a relatively unexamined practice in the USA, organs are procured from unrepresented decedents without their express consent. Unrepresented decedents have no known healthcare wishes (...) or advance care planning document; they also lack a surrogate. The Revised Uniform Anatomical Gift Act of 2006 sends a mixed message about the procurement of organs from this patient population and there are hospitals that authorise donation. In addition, in adopting the RUAGA, some states included provisions that clearly allow organ procurement from unrepresented decedents. An important unanswered question is whether this practice meets the canons of ethical permissibility. The current Brief Report presents two principled approaches to the topic as a way of highlighting some of the complexities involved. Concluding remarks offer suggestions for future research and discussion. (shrink)

Adolescents are increasingly at risk for sexually transmitted diseases (STDs), including human immunodeficiency virus (HIV) infection. The prolonged latency period, sometimes in excess of five years, and the incubation period of up to 10 years before the manifestation of symptoms, may foster adolescents’ false sense of invincibility and denial as they often do not see the devastating effects of the disease in their peers until they are older. In turn, their practice of safer sex may be hindered and thereby contribute (...) to the escalation of this public health crisis among sexually active adolescents. Prevention-focused recommendations were made in the USA as a result of this crisis. Recommendations were made to: (1) include STD/HIV education in the curricula of grades kindergarten to 12; (2) increase to at least 75% the proportion of primary care and mental health professionals who provide age-appropriate STD/HIV prevention counselling to adolescents; and (3) expand HIV prevention services to include age-appropriate HIV education curricula for students in grades 4-12 in 95% of schools. Yet, in the USA, the provision of school-based comprehensive STD/HIV education has been difficult to achieve owing to certain limitations and, in some instances, legal action. These limitations include: limited student access; restricted content; and the implementation of sporadic and/or brief educational programmes. Given these recommendations and the fact that adolescents are acquiring STDs and HIV infections at increasing rates, and despite the limitations and legal actions, do health care professionals not have an ethical obligation to provide adolescents with comprehensive STD/HIV prevention education? This ethical dilemma will be discussed using the ethical decision-making principles of ‘autonomy’ and ‘beneficence’, and a decision-making model proposed by Thompson and Thompson, and by Chally and Loric. Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight salient case (...) text, was shown to be capable of predicting decisions, but attention-weight-based text highlighting did not demonstrably improve human decision speed or accuracy in an evaluation with 61 human subjects. The second approach, termed semi-supervised case annotation for legal explanations, exploits structural and semantic regularities in case corpora to identify textual patterns that have both predictable relationships to case decisions and explanatory value. Victorian poets Elizabeth Barrett (1806-1861) and Robert Browning (1812-1889) first fell in love through letters, which they began to write to each other in 1845 (Figures 1 and 2). Their growing relationship, slowly progressing from letter to first encounter and eventual secret marriage in 1846, is documented in two volumes of letters, with a plot that unfolds as warmly and compellingly as the best page-turner invented by a novelist. Both were master wordsmiths, so the beauty of their letters is no (...) surprise. But one reason Barrett Browning was such a prolific correspondent is that she spent much of her life housebound, due to an illness whose nature was never truly explained when she was alive and that has been .. As a background notion commonly ascribable to all actual beings, the idea of "concern" affords Weiss continuity; in the operation of its actual exemplifications it accounts for novelty and sometimes for radical discontinuity. The major concept of freedom in Weiss's cosmology is not an infinite, wholly vacuous freedom, a completely pure chance, lacking reference to any object or objectives; it is specified in concerns which do have reference both to other entities and to internal demands. I present a reconstruction of the logical system of the Tractatus, which differs from classical logic in two ways. It includes an account of Wittgenstein’s “form-series” device, which suffices to express some effectively generated countably infinite disjunctions. And its attendant notion of structure is relativized to the fixed underlying universe of what is named. -/- There follow three results. First, the class of concepts definable in the system is closed under finitary induction. Second, if the universe of objects is countably (...) infinite, then the property of being a tautology is \Pi^1_1-complete. But third, it is only granted the assumption of countability that the class of tautologies is \Sigma_1-definable in set theory. -/- Wittgenstein famously urges that logical relationships must show themselves in the structure of signs. He also urges that the size of the universe cannot be prejudged. The results of this paper indicate that there is no single way in which logical relationships could be held to make themselves manifest in signs, which does not prejudge the number of objects. Kirby focuses particularly on postmodern approaches to corporeality, and explores how these approaches confine the body within questions about meaning and interpretation. Kirby explores the implications of this containment in the work of Jane Gallop, Judith Butler, and Drucilla Cornell, as well as in recent cyber-criticism. Decision theory and folk psychology both purport to represent the same phenomena: our belief-like and desire- and preference-like states. They also purport to do the same work with these representations: explain and predict our actions. But they do so with different sets of concepts. There's much at stake in whether one of these two sets of concepts can be accounted for with the other. Without such an account, we'd have two competing representations and systems of prediction and explanation, a dubious (...) dualism. Folk psychology structures our daily lives and has proven fruitful in the study of mind and ethics, while decision theory is pervasive in various disciplines, including the quantitative social sciences, especially economics, and philosophy. My interest is in accounting for folk psychology with decision theory -- in particular, for believe and wanting, which decision theory omits. Many have attempted this task for belief. (The Lockean Thesis says that there is such an account.) I take up the parallel task for wanting, which has received far less attention. I propose necessary and sufficient conditions, stated in terms of decision theory, for when you're truly said to want; I give an analogue of the Lockean Thesis for wanting. My account is an alternative to orthodox accounts that link wanting to preference (e.g. Stalnaker (1984), Lewis (1986)), which I argue are false. I argue further that want ascriptions are context-sensitive. My account explains this context-sensitivity, makes sense of conflicting desires, and accommodates phenomena that motivate traditional theses on which 'want' has multiple senses (e.g. all-things-considered vs. pro tanto). From this and new resistance constructions, we prove for the first time that there exists a neutral, anonymous election scheme that is resistant to all twenty standard types of electoral control. According to the Desiderative Lockean Thesis, there are necessary and sufficient conditions, stated in the terms of decision theory, for when one is truly said to want. What one is truly said to want, it turns out, varies remarkably by context—and to an underappreciated degree. To explain this context-sensitivity—and closure properties of wanting—I advance a Desiderative Lockean view that is distinctive in having two context-sensitive parameters.

I then object to possible solutions, and give my own, based on *some-things-considered desire*. Considering the fun of the concert, but ignoring the drive, you want to see the concert; considering the boredom of the drive, but ignoring the concert, you don’t want to take the (...) drive. Physical Relativity explores the nature of the distinction at the heart of Einstein's 1905 formulation of his special theory of relativity: that between kinematics and dynamics. Einstein himself became increasingly uncomfortable with this distinction, and with the limitations of what he called the 'principle theory' approach inspired by the logic of thermodynamics. A handful of physicists and philosophers have over the last century likewise expressed doubts about Einstein's treatment of the relativistic behaviour of rigid bodies and clocks in motion in (...) the kinematical part of his great paper, and suggested that the dynamical understanding of length contraction and time dilation intimated by the immediate precursors of Einstein is more fundamental. Harvey Brown both examines and extends these arguments, after giving a careful analysis of key features of the pre-history of relativity theory. He argues furthermore that the geometrization of the theory by Minkowski in 1908 brought illumination, but not a causal explanation of relativistic effects. Finally, Brown tries to show that the dynamical interpretation of special relativity defended in the book is consistent with the role this theory must play as a limiting case of Einstein's 1915 theory of gravity: the general theory of relativity.Appearing in the centennial year of Einstein's celebrated paper on special relativity, Physical Relativity is an unusual, critical examination of the way Einstein formulated his theory. It also examines in detail certain specific historical and conceptual issues that have long given rise to debate in both special and general relativity theory, such as the conventionality of simultaneity, the principle of general covariance, and the consistency or otherwise of the special theory with quantum mechanics. Algorithms wield increasing control over our lives—over which jobs we get, whether we're granted loans, what information we're exposed to online, and so on. Algorithms can, and often do, wield their power in a biased way, and much work has been devoted to algorithmic bias. In contrast, algorithmic neutrality has gone largely neglected. I investigate three questions about algorithmic neutrality: What is it? Is it possible? And when we have it in mind, what can we learn about algorithmic bias?

BackgroundProfessional health care practice should be based on ethical decisions and actions. When there are competing ethical standards or principles, one must choose between two or more competing options. This study explores ethical dilemmas experienced by International Board Certified Lactation Consultants.MethodsThe investigator interviewed seven International Board Certified Lactation Consultants and analyzed the interviews using qualitative research methods.Results"Staying Mother-Centred" emerged as the overall theme. It encompassed six categories that emerged as steps in managing ethical dilemmas: 1) recognizing the dilemma; 2) identifying (...) context; 3) determining choices; 4) strategies used; 5) results and choices the mother made; and 6) follow-up. The category, "Strategies used", was further analyzed and six sub-themes emerged: building trust; diffusing situations; empowering mothers; finding balance; providing information; and setting priorities.ConclusionsThis study provides a framework for understanding how International Board Certified Lactation Consultants manage ethical dilemmas. Although the details of their stories changed, the essence of the experience remained quite constant with the participants making choices and acting to support the mothers. The framework could be the used for further research or to develop tools to support IBCLCs as they manage ethical dilemmas and to strengthen the profession with a firm ethics foundation. (shrink)

The tendency in the past has been for aruhropobgists to rationalize away the native claim that spirits exist. But in this study, a number of incidents, some of which happened to the author, are described and used to bring this positwistic assumption into question. The author shows that "participant observation" in the fullest sense requires taking the final leap and "going native" in the most complete way possible.

Walter Benjamin’s texts both present and reenact this violence. Reading Benjamin, Werner Hamacher expounds these moments of violence as (...) structural necessities. The article focuses on the question of distance as the objective of reading, and of drawing terminological distinctions—an objective, it is argued, that is driven by counteracting dynamics in reading, which follows the dictate of a text, and in excessive modes of speech such as plaintive language, which keeps claiming attention while refusing symbolic substitution in order to insist that it cannot be answered, satisfied, or appeased. The paper is sympathetic to the idea that speakers have implicit knowledge of the semantics of sub-sentential elements of language, loosely, of words. Implicit knowledge is knowledge which the subject need not be capable of articulating yet which is a genuine propositional attitude and it is to be contrasted with tacit knowledge which refers to an information-bearing state which, however, is not a genuine propositional attitude. I begin by defending the implicit knowledge conception of speakers' knowledge of the meanings of (...) words from a challenge articulated by Evans and then go on the offensive against positions which attempt to replace the notion of implicit knowledge in semantic theory by that of tacit knowledge. Russell takes his paper ?On denoting? to have achieved the repudiation of the theory of denoting concepts and Frege?s theory of sense, and the invention of the notion of incomplete symbols.This means that Russell attempts to solve the set theoretic and semantic paradoxes without making use of a theory of sense.Instead, his strategy is to revise his logical ontology by arguing that certain symbols should be treated as incomplete.In constructing such arguments Russell, at various points, makes use of epistemological and (...) metaphysical considerations.These arguments do not form themselves into a systemic set of considerations to be used in appraising a logical system.Finally, the vicious circle principle is argued for on the basis of considerations, which are presumed evident, about the nature of propositional functions.The stringency of this principle is a basic problem for the system of Principia mathematica.However, even given the terms of the argument, ?On denoting? does not offer a complete repudiation of the notion of sense.This allows the possibility of retaining some of the insights of Principia mathematica whilst rejecting the stringency of the vicious circle principle.The basis of such a system is the theory of sense.
